ABC News has just published a very timely review on the state of debt and debt collections in America.

More than 35% of Americans are in some for of Debt Collection Action.

The Percentage of Americans in some form of collections has remained fairly steady, while the size of credit card debt has actually declined.

Credit Card Debt as a percentage of income, has reached its lowest level 10 years.

Only 2.44% of all credit cards are overdue by more than 30 days, as opposed to a 15 year average of almost 4%.

If the amount of credit card debt is being handled much better by Americans in general, why is it that better than 1 in 3 American's are still in collections.

The answer to that seems to lie in that American income has not really grown, and that expensive credit card debt is being taken care if instead of other debt.  Gym contracts, Cell Phone Contracts, mortgages, Auto Loans seem to be taking a back seat to managing credit cards.

Perhaps this is a good thing, perhaps not.  The American Psyche seems to be saying, Credit Cards cost me more, I will pay them first, and perhaps as that debt gets more and more controlled, the population will be able to turn to their other debts with the same diligence.

Real income needs to grow to resolve our massive debt crisis.

Improving Your Credit Score

As Debt Collection Attorneys in Florida, we see many people making a valiant effort to clear off their debt to improve their credit score.   A high score can get you better insurance rates, easier mortgage approvals, smaller down payments and a host of other very real advantages that ultimately put more money back in your pockets.

The first step to good credit is obviously to show a strong payment history.  If you've fallen behind, and are working with our debt collection attorneys, now is the time to work incredibly hard at getting run away debt out of control.

Once that has been done here are the next steps.

1.  Get a new credit card
nearly a third of your credit score is based on you credit utilization.  The amount of credit you use compared to the amount of credit available.   Industry experts suggest keeping your credit utilization scores below 30%.  Opening a new line of credit, and moving your debt around, BUT NOT increasing your total debt, will create a lower credit utilization score.

2.  Always monitor your credit score online.
This goes without saying, and there are many ways to get your credit score free, or for very little cost.  The bottom line is you can't improve something if you don't know where you are starting from.

3.  Take on a new loan.
A tenth of your score is based on the types of accounts you have.   If all your debt is in credit cards, and none in a car loan, this does not appear to be reasonable use of credit.  When you shop new credit types, be sure to shop carefully, and don't fall in the trap of adding very expensive debt.

Senate Mandates Private Tax Collectors

Is anyone remembering our past?

Back in April, the Senate Finance committee approved a services of business friendly tax breaks, expected to cost $85 Billion a year.  To help pay for these tax breaks, one of the tactics was to employ private tax collectors.

Yes... any of us that have sat on the other side of a tax collectors desk, with their extreme power over debtors, must wonder what we in the private sector will be able to do to be more efficacious in debt collection, especially after the sweeping debt collection reform legislation that has significantly impacted out business.


The truth is that the Treasury Department already has the authority to use debt collectors but doesn't, for the simple reason, it doesn't work!  The IRS has followed this path on two other occasions, and also failed - failed horribly.

Back in 1996, the pilot program resulted in $17Million loss to the IRS, great profits to the debt collectors, and la suites over the violation of the Fair Debt Collection Act.

With the massive sweeping reforms to tighten the FDCPA, how much more successful could this adventure be?

While anything to support the Tax Collection Industry at this stage would be a lifeline to those collection attorneys that are not adapting well to new legislation, the fact of the matter is, Tax information is among the most heavily protected information that the US government holds.  Almost all of it protected from sharing with outside entities.  We debt collectors cannot by law be given enough information to collect a debt.

The IRS with its immunity from FDCPA, manages to collect 62% more in back taxes than private collection agencies in past tests.

The real issue here is that the IRS has the ability to use strong arm tactics that would land debt collectors in jail.  Solving a pure staffing and backlog past due debt collection effort by the IRS by hiring private collection attorneys, who do not have the tools at the IRS's disposal, nor frankly would we want them, is just not the right answer.

While the prospect of increasing the private debt collection industry, perhaps exponentially, is certainly appealing.. perhaps.. cleaning their own house, and training more collectors internally, given their success rate using draconian collection methods not available to the public, is a more rational exercise.

Who among us has the brevity to ignore the past due tax bill letter, as opposed to discarding dunning notices from the Tax Collection Attorneys.

Is it any surprise that the Tax Collection Agencies approved seem to be from the states that the two Senators that put forward the bill are from?

1.  Pay in advance for Credit repair or Debt Settlement Services.   If you are asked to pay up front, you may as will kiss that money goodbye because it is illegal for these services to charge you upfront fees.  

2.  Pay for a Credit Repair service, when you can do it yourself.   There is a  mountain of online resources to help you clean up your credit report to get rid of errors.   A service will likely be no more successful than you are in clearing of legitimate debt from your score.  Paying for these services is nonsensical, that money could go toward debt, instead of lining the pockets of someone that wants to charge you for something you could do for free.

3.  Paying for a debt settlement service.   We aren't saying that people never settle on a debt.. but there are generally guidelines.   If a creditor is prepared to take 50 cents on the dollar, your debt settlement service is likely to gobble up at least half of that, and walk away with half the savings.  Rather than avoiding your debt collectors, and debt collection attorneys, work directly with them, perhaps you can negotiate a debt settlement.. and all the savings will be yours.  Also a debt settlement may not help your credit worthiness any... things to consider.

When it comes to paying debt you owe, there is no silver bullet.  There are many people that pray on debtors trying to extract fees for false promises.  We have little respect for those that would pray on those who can least afford it.  It is astounding that debt collectors and debt collection attorneys are relegated the difficult job of collecting debt with dignity, and are dreaded, where the people that pray on the debtor selling false hope at a high price are lauded as heroes.

There is no quick fix, other than working with your collection professional the old fashioned way, and pay what you owe.

Consumer confidence highest in 6 years in June.

Impressive job growth and increasing stock prices has been raising consumer confidence as it hit a new high this month.

Consumer Confidence Statistics

The consumer confidence index rose to 85.2 from 83.5 in May according to the Conference Board. That is the highest the index has been since 2008, and economists were expecting a reading of 83.5.
The first quarter saw a slight decrease in the economy for the first time in three years, but the happiness of consumers is directly related to the labor market. Monthly job gains have increased up to 231,000 up from 194,000 in 2013.
The leap in the index is heavily influenced by the outlook of current conditions by consumers. Consumers saying that business conditions are favorable rose to 23% from 21%. In addition, those that said conditions are bad fell to 22.8% from 24.6%.
Perceptions across the nation have also changed. 14.7% of consumers that were surveyed in June felt that jobs were plentiful, up from 14.2% in May. There was a .4% decrease in those that said jobs were harder to get – 31.8% down from 32.2%.

Bitcoins; a solution for the unbanked

The banking world has suffered an approach to the internet world. Change is coming, although slow and painful. This is because people are already familiar with the old system, such as banking. But for the unbanked, the old system is not very helpful. Therefore, we moved forward by accepting payments that worked well in the physical world but have failed on the internet. The time to change is usually when the return on investment justifies the outcome.

Mobile Money

T-Mobile launched a program called Mobile Money in January which acts as a prepaid Visa debit card attached to a T-Mobile account. The financial institution in the background is Bancorp.
After a big underserved segment of the American Populace, Mobile money is becoming bigger and bigger within the phone industries. The way this w3orks is that a customer can add money to their phone account at the correlating stores or link their paychecks to direct deposit into their accounts. The goal is that people will be able to manage their accounts and pay bills from their smartphones through app or web.
Carriers such as Sprint’s Boost Mobile were successful at launching similar services of banking known as Mobile Wallet which held higher transaction fees.
Sprint’s competitor, T-mobile, offers lower rates and flexible prepaid services for those customers who are without access to standard banking protocol. The flexibility makes the service stand out from Isis (the mobile payments operator T-mobile founded alongside AT&T and Verizon) because while Isis aims to keep customers using their phones in replacement of a debit or credit card, Mobile Money is designed to give customers access to these cards from the start.

Cash

Moving this idea of mobile based products or a spending card has proven to be a challenge. Cash has surprisingly remained significant to all segments as consumers prefer the perceived convenience of money rather than the alternatives. Mobile Money’s goal is to make mobile payment products faster and more convenient than what exists today and unfortunately, this is not yet the case.
The antidote to the problem is Bitcoin. Bitcoin is a cash equivalent system online or on apps that easily transmit payments via phone or Internet.

Bitcoin is essentially internet money. Helping the unbanked, an agency accepting Bitcoin or Mobile Payments, eChecks and Debit cards prove to provide one more way to accept a payment that the customer can transact.
There are many cases that this not yet known way of internet money has been received and customers are completely oblivious to it. They may receive Bitcoins as a gift and be ignorant to the fact that they can make payments with them because of the lack of knowledge on how to trade them for dollars. As a solution to this problem, the logic would be to create a “Bitcoin Accepted Here” account. For those who do not have this c\account, currently Coinbase.com as well as Bitpay.com have a system where you can exchange Bitcoins for cash that are deposited into your account.
This world is evolving into a more technologically based world where there are 6.5 billon cell phones and only 1.5 billion bank accounts. In order to help the unbanked, it is time to adapt.

The Great Recessions’ Impact

Throughout the two year course of the Great Recession, Tampa by itself lost 140,700 jobs. In effect of this, job seekers outnumbered job openings by a significant amount. One would expect that in order for structural unemployment to be a part of overall the unemployment, there would have to be a consistent number of labor shortages in some areas due to unsuitable applicants. But unfortunately this is not the case. Unemployed workers proved to significantly outnumber job openings in every sector. This meant that the main issue of the Great recession wasn’t the lack of correct workers, but instead the lack of jobs.

The Study

A WalletHub study expressed the rankings of the largest cities in order based on 13 different metrics. These metrics included industry variety, employer-provided health benefits, costs of living and job openings per capita. The organization of this list was based on the strength of the job markets within each city, as well as the greatest prospects for long term financial security within each job opening.

The WalletHub study shows that Tampa was ranked the number 3 best city for employment in the nation,  number 8 for best paid after the cost of living was taken into account, and number 9 for the most diverse industrial mix.

While Washington D.C. ranked number one on this list, two other Florida cities on the list included Jacksonville at number 35 and Miami at number 30.

How to make sense of your credit report

Breaking down this important record — how to read it, how to fix it

It’s important to check your credit regularly when you are trying to build quality credit and avoid identity theft. There are three nationwide credit agencies: Experian, Equifax, and TransUnion that can provide a free credit report once every 12 months. It’s not always the easiest thing to decipher a credit report and know what to look for.
Here are some tips.

Credit report vs. credit score — what’s the difference?  

Your credit report has more information and is more in-depth than just your credit score. (Your score is not included in the free report, but can be authorized by federal law for a free.)
The credit report is a detailed listing of all your debts and payments going back through your entire payment history. According to Kevin Gallegos, vice president of Phoenix operations for Freedom Financial Network, “For each credit account you have, the report shows creditors’ names, the amount owed, the highest balance owed, available credit, whether the account is open or closed (and who closed it), the number of times a payment was past due and whether the account is in default.”

The five sections of your credit report include: 

  • Identifying information. This is where you’ll find your name, address, date of birth, Social Security number and aliases. It may be a good idea to review this information, because you may end up getting charged for debts that do not belong to you.
  • Creditor information. This section is usually the longest and contains all of your information such as; how much you owe, who you owe, current or past due debts, whether it is opened or closed, and other status information. It’s imperative to make sure that this information is correct.
  • Collection accounts. This section lists any and all accounts that are in collection. Make sure this information and is accurate, and if you do have debts try to pay them off as soon as possible. Once the debts are paid, be sure to ask the credit bureaus explaining that the debt is paid off.
  • Public records. Information regarding bankruptcy judgments, liens, and overdue child support will be displayed here. Review for accuracy as bankruptcy and financial problems can remain for 7-10 years.
  • Inquiry section. This section is a list of businesses that have reviewed your credit information. If there are unfamiliar names checking out your credit, it would be best to contact them and find out why.

In the majority of cases the credit score ordered will be your FICO score which is named for the company that developed it in 1989. Each agency has its own way of calculating the credit score so your FICO score can vary depending on the credit bureau that provides the score. The exact formula for determining a FICO score is classified, but FICO does disclose some basics that can impact your score. For example:
  • Payment history. Any late payments – credit card, car loans, or mortgages will cause a negative impact to the FICO score. On-time paid bills will increase the score. 35% of a FICO score is applied here.
·         Amounts owed. If there is a history of small balances and payments made on time, your score will improve. If there are high percentages of credit owed, it will likely harm your score. This category accounts for 30% of a FICO score.
·         Length of credit history. This accounts for 15% of your score and it determines how long your credit accounts have existed and how long since you have utilized some of the accounts.
·         Types of credit used. This is worth 10% of your FICO score and looks at a mixture of a number of loans, including mortgage, revolving, installment, and consumer finance. Having different types of credit is beneficial for your score.
  • New credit. The last 10% of your FICO score is determined by how many new credit accounts are opened up in what period of time. The shorter period of time with more accounts, the more it hurts your credit score overall.
The percentages for each category should be able to assist consumers in determining what areas are most impactful to their credit score.

What if there is an error on my credit score?

If there is a problem with your credit score, call the credit bureau that provided the report and state your case. The bureau is required to make fixes within 30 days or the line of credit must be halted until the problem is fixed. Be sure to plan accordingly and pay off any and all revolving debt!
